    GENERAL TERMS AND CONDITIONS

    (“T&C”)

    Welcome to the Morejoylife website, operated under the domain www.morejoylife.com (hereinafter referred to as the "Service Provider"). Please read the General Terms and Conditions (hereinafter referred to as “T&C”) set forth in this document carefully before making a purchase.

    Furthermore, in the privacy policy, you will find all necessary information related to our products, purchasing, payment, delivery, and the handling of your personal data. If you have any unanswered questions after reading the referenced documents, please contact us via the email address provided in the T&C and the Privacy Policy for prompt assistance at morejoyfullife@gmail.com.

    Firstly, please be informed that the Service Provider ships products ordered from the web store to private individuals (consumers) not only within Hungary but also to European Union member states and outside the European Union (hereinafter referred to as "Non-EU countries") with the assistance of the DDP courier service. According to Government Decree 335/2012 (XII.4.), § 3/A, within Hungary, the Service Provider ensures delivery through Magyar Posta Zrt. (Hungarian Post).

    GLS/Magyar Posta Zrt (within Hungary) and DDP (to EU member states and Non-EU countries) are hereinafter referred to as “Courier Service(s)”. Delivery times within Hungary are 6-12 days, while to EU member states and Non-EU countries, it is 6-12 working days, with the courier services undertaking delivery to the respective destination country. Orders placed in the web store must come from one of the European Union or Non-EU countries (billing address); however, the delivery address can be in any other European Union or Non-EU country.

    The estimated delivery times are only provided as a guide. The Service Provider is not responsible for delays caused by customs procedures in the destination country.

    For customers in Non-EU countries where we deliver under DDP (delivered duty paid) shipping conditions, the applicable import duties, taxes, and handling charges will also be included. These costs are included in the final purchase price.

    We also inform businesses registered in Hungary (both companies and individual entrepreneurs) that our business only serves private individuals.

    Regarding orders and deliveries from European Union member states and Non-EU countries, we inform you that all contractual obligations related to the purchase of products through the web store (including issues related to the formation, validity, and performance of the contract) are governed by Hungarian law, as per Article 3(1) of Regulation (EC) No. 593/2008 of the European Parliament and of the Council (Rome I). By finalizing the purchase and accepting the T&C – by checking the corresponding box – the Buyer acknowledges this and considers it binding. These T&C are available in both Hungarian and English versions, which are fully consistent with each other.

     

    In the event of any differences or contradictions between the Hungarian and English versions of the T&C despite careful translation, the Hungarian version shall prevail. If any clause of the T&C is deemed invalid or unenforceable, it does not affect the validity or enforceability of the remaining clauses.

    Our web store operates in Hungary, and its maintenance is also carried out here. The Service Provider is not subject to any codes of conduct.

    These T&C are effective as of August 1, 2024. For matters not regulated in these T&C and for their interpretation, the following legal provisions shall apply:

    • Regulation (EC) No. 593/2008 of the European Parliament and of the Council on the law applicable to contractual obligations (Rome I)
    • Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights
    • Act V of 2013 on the Civil Code (Ptk.)
    • Act CVIII of 2001 on certain issues of electronic commerce services and information society services (Ektv.)
    • Act XLVIII of 2008 on the basic conditions and certain restrictions of economic advertising activities (Grtv.)
    • Government Decree 45/2014 (II.26.) on the detailed rules of contracts between consumers and businesses (Korm. rendelet)
    • Government Decree 335/2012 (XII.4.) on the provision of postal services (Posta rendelet)
    • Act CLV of 1997 on Consumer Protection (Fgytv.)
    • Act XLVII of 2008 on the prohibition of unfair commercial practices against consumers
    • Decree 19/2014 (IV.29.) of the Ministry of National Economy (NGM) on the procedural rules for handling warranty and guarantee claims for goods sold under contracts between consumers and businesses

    I. Terms and Definitions Used in the Online Store

    T&C: General Terms and Conditions. A set of rules that includes the rights and obligations of the Service Provider and the Buyer/Visitor, the applicable law, the steps for using the online store and making purchases online, the payment methods, the conditions and fees for delivering ordered products, the conditions for exercising the right of withdrawal, and the options for legal remedies.

    Privacy Policy: A document that outlines the principles and aspects of the Service Provider's handling of personal data, the data processing activities related to the operation of the online store, and provides information to the concerned parties. This is available in a separate document.

    Service Provider: The owner and operator of the online store accessible through the internet address www.morejoylife.com. The data and contact details of the Service Provider, the Hosting Service Provider providing hosting for the Service Provider, and the Courier Services providing product delivery can be found under the following Section II.

    Financial Partner: The electronic payment in the online store is conducted through its own online payment platform via Shopify.

    Buyer: A natural person (Consumer) who, after prior registration or without registration, enters the online store for the purpose of making a purchase and buys online.

    Consumer (Civil Code): "A natural person acting outside their trade, independent profession, or business activity." This refers to individual buyers.

    Visitor: A natural person (Consumer) who visits the online store for browsing purposes.

    Sales Contract: A contract formed between the Service Provider and the Buyer who intends to order a Product, established upon the Service Provider’s confirmation of an Order placed by the Buyer on the online order form available on the Service Provider's Website.

    Mail Order Commerce: A commercial activity in which the trader provides the buyer with commercial communication displaying the characteristics and price of the product, thereby enabling the buyer to make a transactional decision to purchase the goods, and delivers (or arranges delivery of) the ordered product to the specified address based on such commercial communication.

    Mail Order Trader: A person engaged in mail order commerce.

    Electronic Commerce Service: An Information Society Service aimed at the professional sale, procurement, exchange, or other means of utilization of any moveable tangible object - including money and securities, as well as natural forces that can be utilized in the manner of things - services, real estate, or rights of pecuniary value.

    Electronic Means: The application of wired, radio technology, optical, or other electromagnetic tools for electronic data processing, storage, and transmission.

    Website: This current website, i.e., the internet site operated by the Service Provider under the domain www.morejoylife.com, which serves the purpose of concluding contracts.

    Product: Goods that can be ordered online from the web store.

    III. General Information

    (Purchasable Products)

    The displayed products can only be ordered online. The displayed prices for products are in Hungarian Forint for Hungary, in Euros for EU member states, and in Dollars for Non-EU countries. For sales outside the EU, the invoice will be issued with the remark "sale outside the territorial scope of VAT" (gross prices) and include home delivery fees. No additional packaging costs will be charged. The invoice will always be sent electronically after payment.

    1. The Service Provider allows Consumers who visit the online store for the purpose of purchasing to select and buy products online without prior and mandatory registration in the online store. Buyers are entitled to select and purchase any product available in the online store without registration. Registration is also not required for browsing the online store, viewing products, and associated textual content.
    2. The Service Provider is entitled to unilaterally modify the T&C at any time. The modified T&C will become effective upon publication in the online store and will be binding on the Service Provider and the Buyer/Visitor from the time of publication.
    3. The Service Provider reserves the right to maintain, upgrade, develop, etc., the online store at any time (hereinafter: maintenance). The Service Provider strives to perform maintenance activities with minimal disruption to the Buyer/Visitor. The Buyer acknowledges that access to the online store (viewing products and associated textual content, ordering products) may be limited or unavailable during the maintenance period.
    4. A condition of purchase is the acceptance of the T&C and the Privacy Policy and the consent to personal data processing.
    5. During the purchase, the Buyer is obliged to provide accurate personal data requested by the Service Provider and immediately notify the Service Provider via email of any changes in the provided data (e.g., email address, postal address, phone number, etc.). If the Buyer fails to notify the Service Provider or provides incorrect data, the Service Provider excludes its liability for any damage, failed delivery, or delayed delivery resulting from this. The Service Provider also excludes its liability for purchases made using another person's data.
    6. The Service Provider endeavors to present all the displayed information necessary for selecting and ordering products (including color images of the products, their characteristics, descriptions, gross consumer and unit prices, and other relevant information, such as delivery information, conditions, and fees, warranties, etc.) in adequate quality and size for the Buyer/Visitor. Any illustrations, decorations, or other products displayed alongside the product are not part of the sold product. Procedure in case of erroneous pricing: The Service Provider continuously strives to correctly display the products and associated textual content in the online store and to update (refresh) the displayed data and information in case of changes. If you notice any obvious errors (e.g., prices of 0 HUF, 0 EUR, or 0 USD), please notify us immediately via email. Product selection and ordering in the online store are continuously available to Buyers 24 hours a day. However, in the case of the exceptional events listed below, the operation of the online store may become partially or completely inoperative, for which the Service Provider excludes all liability. a. The Service Provider is not liable for cases where the online store becomes inaccessible or only partially accessible due to force majeure. Force majeure events under this T&C include unavoidable external causes or forces (e.g., natural disasters, strikes, elemental damages, hacker attacks, etc.) that are obviously beyond the Service Provider's operational scope. b. The Service Provider is not liable for cases where the services of the online store are not or are only partially available due to technical errors or force majeure at the internet service provider or hosting provider ensuring the accessibility and operability of the online store.

    The Web Store may provide discount shopping opportunities in the form of coupons at certain times or occasions selected by the Service Provider. In such promotions, partial or full payment of the product price can be made by entering the coupon details on the internet interface during payment and ordering. The coupon code must be entered during payment, within its validity period and according to its usage conditions. ..into the appropriate field. Further details of the terms of use for the coupons are included in the current coupon promotion conditions. Here is what you need to know about the shopping voucher (coupon):

    • The shopping voucher is non-transferable and cannot be combined with other discounts/vouchers;
    • The code on the shopping voucher can only be used once, and the amount of the voucher will be deducted as a discount from the total amount of the products selected and placed in the cart (i.e., the Basket) during payment.

    Further details of the terms of use for the coupons are included in the current coupon promotion conditions, which the Service Provider sends out in the current newsletter to subscribers.

    IV. The Purchasing Process, Information on Purchasing, Payment, and Shipping

    1. The process of online purchasing and shipping through the online store – without mandatory registration – is as follows: a. The languages available in the online store (Hungarian, English, German), the currency needed for payment (HUF or EUR or USD). Within Hungary, delivery is carried out by Magyar Posta Zrt. and GLS. b. Outside the EU or within the EU: For customers outside the European Union, we deliver under DDP (Delivered Duty Paid) shipping conditions. c. Registration is not required for the Consumer to make a purchase. Registration can be done on the online store's interface. d. The Consumer has the option to delete their account, and upon deletion, the Service Provider will also delete all personal data stored about them (except those that must be retained due to legal requirements – e.g., for the duration specified by the Accounting Act related to purchases). e. The Consumer selects the products they wish to order in the online store. If any product is unavailable (not orderable) for any reason, the online store will not allow it to be placed in the cart. Some products can only be ordered in specific quantities (5, 10, 15, 20, etc.), which the Service Provider clearly indicates for the affected products. f. The Consumer places the selected products in the cart by clicking on the “Cart” icon. The Consumer can continuously modify the quantity of the products already placed in the cart by clicking the “+” and “-” buttons or delete them by clicking the “Trash/Delete” menu item. g. After placing the products they wish to purchase in the cart, the Consumer can proceed to the “Checkout” interface for payment by clicking on the “Continue” menu item. If the Consumer decides to purchase additional products or modify/delete the quantity of the already selected products before payment, they can still do so as previously described. h. On the “Checkout” interface, the Consumer provides their name, email address for contact, phone number, shipping address, and billing information, and selects the payment method (prepayment, bank card, or cash on delivery – the latter only within Hungary). Payment for orders outside and within the EU can only be made by prepayment or bank card, as permitted by the system. i. By clicking on the “Summary/Total” menu item, the Consumer reviews the order and sends it to the Service Provider by clicking on the “Order with Payment Obligation” menu item. j. Depending on the total amount of the order, the progress of the order can be continuously tracked before submission. k. If delivery is not free of charge, the Consumer must separately accept the delivery fee before clicking on the “Order with Payment Obligation” menu item, otherwise, the system will not allow the order to be sent. Another condition for submitting the order is the acceptance of the T&C and the acknowledgment of the Privacy Policy, with consent to personal data processing (by checking the corresponding checkboxes). The system will not allow the order to be sent until this is done. The Consumer can continuously delete products already placed in the cart and/or modify the quantity of the purchase as previously described.

    Payment Options:

    1. Bank card payment: (Visa or MasterCard)
    2. PayPal: (During payment, the system automatically redirects to the bank card payment interface. The User can pay the total order amount online with a bank card through the secure payment system of the financial service provider (Shopify Payments) used by the Service Provider.)

    Paying with PayPal: The process of purchasing with PayPal:

    • The transaction details appear on the left side of the page, and there are two options on the right side: a) If you have a PayPal account, after entering the valid ID and password, you will see the partial details of the pre-registered bank card and the amount to be paid. If multiple cards are registered, you need to select the card you want to use for payment. After selection, click on “Pay Now” to complete the payment and you will shortly return to the store's page. b) If you do not have a PayPal account, you can complete the payment as a guest after filling out a form without registering with PayPal. The form requires the following data (most of these fields are mandatory):
      • Country
      • Card number: Bank card number
      • Payment Types
      • Expiration date: The expiration date of the bank card in mm/yy format
      • CSC code: The three-digit security code on the back of the card (above the signature field on the right)
      • First name
      • Last name
      • Address line 1
      • Address line 2 (optional)
      • City
      • State/Province/Region
      • Postal code
      • Telephone: Please provide a real phone number where your bank can reach you if necessary. Include the country code and area code.
      • Email address: The confirmation of the payment will be sent to the email address provided here. After filling out all fields, click on the “Review and Continue” button at the bottom of the page. Here, you can check the provided data, the amount to be paid, and the order.
      • If everything is correct, approve the transaction. You will receive an email notification about the successful transaction shortly, and at the same time, the Service Provider will also be notified of the successful payment and will start processing the order.
      • If your credit/debit card is not in the same currency as the transaction currency, the final amount will be calculated using the applicable cross-currency exchange rate on that day by your payment service provider/bank. After the successful bank card payment, the system automatically returns to the online store interface, and the “successful transaction” message appears. In the event of an unsuccessful bank card payment, the “unsuccessful transaction” message appears, and the transaction must be repeated.     Prepayment: The Service Provider will send the Consumer the details required for prepayment in the first email confirming the successful receipt and confirmation of the order. For prepayment, the Service Provider will only prepare and hand over the package to the Courier Service after the full amount has been credited to its account, as per Section 6:42 (2) of the Civil Code. Sending the proof of the bank transfer is not sufficient to prove payment. By clicking on the “Order with Payment Obligation” button, the Consumer acknowledges that the click entails a payment obligation for the ordered product and the associated delivery fee, which must be fulfilled according to the chosen payment method. The Service Provider will confirm the Consumer's order, recorded with a unique order identification number, by email. This confirmation will include the total amount to be paid for the ordered product(s) upon receipt, the payment method, the delivery fee, or its possible exemption, and the provided data (name, phone number, email address, shipping address, billing details), as in the order sent to the Service Provider by the Consumer. The attached documents can also be viewed by the Buyer on the website at any time. This confirmation email signifies the successful receipt of the order and the acceptance of the Consumer's order. The Consumer must receive the confirmation email within 48 hours of sending the order. We recommend checking your Spam folder as well, as certain email systems may mistakenly identify confirmation emails (including automatic system messages) as spam. If the email confirming the receipt and processing of the order does not arrive within 48 hours, please notify us immediately at the provided email address. The Service Provider cannot send the order confirmation email to the Consumer if an incorrect email address is provided. The Service Provider will notify the Consumer by email when the package is handed over to the Courier Service. In many cases (e.g., 

    Christmas or other holidays, the current COVID pandemic situation, etc.), the Courier Services may not meet the delivery deadlines due to objective factors beyond their control. After the completed financial transaction, the Service Provider will send the invoice for the order to the Consumer by email. Electronically delivered invoices qualify as remote-printed invoices, and the PDF file sent and received by email is also considered accepted by the NAV under Section 259 (5) of the VAT Act. 

    The Courier Services deliver the ordered product(s) to the specified shipping address on working days between 8 am and 5 pm. The Courier Service will notify the Buyer by email/phone/SMS about the delivery time on the day of delivery. If no one receives the delivered products at the shipping address provided by the Consumer due to the absence of anyone during the specified delivery time given by the Courier Service, the Courier Service will attempt to contact the Consumer at the provided phone number. If this attempt is unsuccessful, a notification will be left regarding the failed delivery. On the delivery day, the Courier Service will make one more attempt to contact the Consumer at the provided phone number to arrange a new delivery time. If this attempt is also unsuccessful, the ordered products will be returned to the Service Provider. In Hungary, the terms of the delivery contract for other countries will apply.

     The Consumer is not obliged to accept products that, during delivery, are found not to be the ordered product or are delivered at a price different from the one listed at the time of the order. It is recommended that the Consumer check the integrity of the received package in the presence of the courier and request a report in case the package is damaged. Failure to do so and the lack of a report may affect the consumer complaint process or other legal enforcement processes. The Consumer is responsible for maintaining the email account provided for contact purposes (ensuring there is enough storage space for order confirmation or other notification emails from the Service Provider and detecting emails that may end up in the Spam folder). The Service Provider excludes liability for any claims or damages arising from the Consumer's failure to meet these obligations.

    The delivery fee and cash on delivery cost for delivery by Magyar Posta Zrt. (MPL package):

    • Up to 10 kg gross: 1,990 HUF
    • 10-20 kg gross: 2,990 HUF
    • 20-40 kg gross: 5,990 HUF
    • The cash on delivery fee, regardless of weight and amount, is uniformly 565 HUF when choosing MPL package.

    The delivery fee to European Union member states and non-EU countries is determined based on the weight of the package and the destination country. The exact shipping fee is continuously updated for the Consumer when placing the product(s) in the cart. Delivery times to the European Union and non-EU countries start when the ordered product is handed over to the Courier Service (DDP).

     

    V. Formation of the Contract, Its Technical Steps, and Other Information Related to Contract Conclusion

    1. By accepting these T&C, the Buyer/Visitor acknowledges that any legal relationship arising from purchases made from the online store is governed by Hungarian law. The contract between the Service Provider and the Buyer, in the language chosen by the Buyer (Hungarian or English), is formed after the following technical steps as described in Chapter V.
    2. The Service Provider retains the buyer's order and the invoice documenting the formation of the contract (purchase) for eight years, in accordance with legal requirements (Section 169 (2) of the Accounting Act).

    VI. The Buyer's (Consumer's) Right of Withdrawal, Complaint Handling, and Other Legal Remedies

    1. Right of Withdrawal: We draw the attention of our Buyers to the fact that the right of withdrawal detailed in this section is only applicable to Buyers who qualify as consumers under the Civil Code. The definition of Consumer as per the Civil Code is specifically indicated in Section I of these T&C.
    2. Additionally, under the rules applicable to the conciliation board, a consumer is defined according to Section 2 (a) of the Consumer Protection Act as "a civil organization, church legal entity, condominium, housing cooperative, micro, small, and medium-sized enterprise that buys, orders, receives, uses goods or is a recipient of commercial communication or offer related to goods." Court remedies are, of course, also available to Buyers who do not qualify as consumers under either definition.
    3. The Buyer is entitled to exercise the right of withdrawal without giving any reason, provided by Article 9 (1) of Directive 2011/83/EU and Section 20 of Government Decree 45/2014 (II.26.) (hereinafter: Government Decree). However, the Buyer cannot exercise the right of withdrawal provided in Section 20 of the Government Decree concerning the products listed in Article 16 (d) of Directive 2011/83/EU and Section 29 of the Government Decree, specifically the products named in Section 1 (d) (exemptions).

    5. The Buyer can exercise the right of withdrawal without justification within 14 days following the receipt of the products ordered from the online store, or between the date of contract conclusion and the date of receipt of the products. This can be done using the statement template at the end of these T&C (Appendix II) – for example, by mail or email – through the contact details provided in Section II. In the case of withdrawal by mail, the 14-day deadline is considered met if the declaration is sent by mail within this period. The same applies to the calculation and adherence to the deadline for sending the email.
    6. The withdrawal/cancellation template is also found at the end of these T&C (Appendix I). The template notice on product warranty and guarantee claims, as specified in the government decree on the regulation of warranty and guarantee claims, can be read in Appendix III of these T&C. The Buyer is entitled to submit a warranty claim under Section 6:157 of the Civil Code if the service does not meet the quality requirements set out in the contract or legislation at the time of performance (faulty performance), except if the Buyer was aware of or should have been aware of the defect at the time of contract conclusion.
    7. The Consumer can prove their warranty claim with an invoice according to Decree 19/2014 (IV.29.) of the Ministry for National Economy. The Service Provider records a report for every warranty claim reported to them, gives a copy to the Consumer, and retains it for three years. During the resolution of warranty claims, if the Service Provider cannot declare the feasibility of the claim within five working days, they are required to notify the Consumer in a verifiable manner. If the claim is rejected, the Service Provider must inform the Consumer about the possibility of turning to the conciliation board.
    8. If the Buyer exercises the right of withdrawal within the deadline, they are obliged to return the product(s) affected by the withdrawal immediately, but no later than 14 days from the notification of withdrawal, at their own cost, or personally deliver it to the Service Provider's headquarters listed in Section II. The return is considered timely if the Consumer sends the product before the deadline expires. The Service Provider must refund the purchase price of the returned products, including delivery costs, within 14 days from the acknowledgment of the withdrawal in the case of personal return, and within the same period for other cases. The refund is made using the same payment method as the original transaction unless the Buyer consents to another method, which does not incur any additional charges for the Buyer. In the case of a sales contract, the Service Provider may withhold the refund until the product has been returned or the Buyer has provided irrefutable proof of return (e.g., a copy of the postal receipt), whichever is earlier. The Service Provider does not undertake the return of the product(s) in the event of withdrawal; the Buyer must return it as a postal parcel or through a courier service to the Service Provider's headquarters specified in Section II.
    9. The Service Provider ensures that the Buyer can make a withdrawal statement without justification through the online store's website using the statement template in Appendix II. In this case, the Service Provider will promptly confirm receipt of the withdrawal statement to the Buyer.
    10. The Buyer, or the person authorized to receive the products upon delivery, may refuse to accept products that are obviously defective at the time of delivery, for example, if the packaging is damaged or torn, and as a result, the packaging can no longer adequately protect the product. In such cases, a report must be requested from the courier representative as specified in point IV/A/1/r).
    11. Complaint Handling: According to the Consumer Protection Act, if a Consumer lodges a complaint with the Service Provider regarding the products, the behavior, activity, or omission related to distribution or sales, the complaint can be submitted personally or through the contact details listed in Section II. The Service Provider examines and remedies the complaint immediately. If the Consumer disagrees with the handling of the complaint or the immediate investigation of the complaint is not possible, the Service Provider records a report on the complaint and its position and provides a copy to the Consumer (if present). In the case of a written complaint, the Service Provider will send a substantive response within 30 days. The Service Provider is obliged to justify its rejection of the complaint. The report on the complaint and a copy of the response will be kept for three years and presented to the authorities upon request.
    12. Further Legal Remedies: If the Consumer's complaint is rejected, several legal remedies are available to the Consumer, which the Service Provider must inform the Consumer about in its rejection response. The Consumer can turn to the Consumer Protection Authority, use the Conciliation Board as a dispute resolution forum, and, of course, choose court settlement for the dispute. Additionally, the Consumer can use the European Commission's online dispute resolution platform for disputes arising from online sales.
    13. As a general rule, the Conciliation Board with jurisdiction is based on the Consumer's place of residence or, if not available, their place of stay.     14. The essence of the procedure before the Conciliation Board: This type of procedure is a possible way to resolve consumer disputes that is cheaper, cost-effective, quicker, and simpler compared to court proceedings. Only consumer protection disputes fall within the jurisdiction of the Conciliation Boards. The goal of the Conciliation Boards is to attempt to create an agreement between the consumer and the business, but even in the case of unsuccessful negotiations, they make a decision in the matter. Participation in the procedure before the Conciliation Board does not preclude the traditional judicial route, which remains available to the Consumer even after the procedure. The procedure before the Conciliation Board is free of charge (naturally, if the Consumer authorizes a legal representative during the procedure, they must bear the costs).
    15. Procedure: If the Consumer has attempted to resolve the disputed matter with the business concerned, but this has not led to a result, the initiation of the procedure must be submitted on a form, the content of which can be accessed via the following link: http://www.panaszrendezes.hu/homepage/index.php/eljaras-menete.
    16. The procedure must be completed within 90 days from the receipt of the application, with an extension of up to 30 days possible in justified cases. The Consumer is free to decide whether to accept the Conciliation Board's recommendation, the settlement offer, or the binding decision. The Service Provider has a duty to cooperate in the procedure before the Conciliation Board, which Renáta Lőrincz Ev. will naturally comply with if such a procedure occurs.
    17. The Consumer may also turn to the Consumer Protection Authorities with complaints related to the Service Provider's complaint handling or other issues falling within the consumer protection authority's scope. Further contact details and other information can be found on the Authority's website.
    18. Naturally, in addition to the procedures mentioned above, the Consumer also has the right to initiate the resolution of the dispute through traditional judicial channels (by submitting a statement of claim). The Consumer can choose the court dispute resolution form after the procedure before the Conciliation Board and independently of turning to the consumer protection authority.
    19. In addition to the previously mentioned legal remedies, the Consumer also has access to the online dispute resolution platform operated by the European Commission for disputes arising from online sales.     VII. Miscellaneous

    • The Seller does not discriminate between Buyers using the Website from within Hungary, the European Union, or outside the European Union.
    • We inform you that the Web Store does not serve minors under 18 years of age.
    • The Seller is not obliged to communicate with the Buyer in the language of the Buyer's Member State.
    • The Seller is not required to comply with any out-of-contract requirements set by the national law of the Buyer's Member State regarding the product in question, such as labeling or sector-specific requirements, nor is the Seller obliged to inform the Buyer about such requirements.
    • Unless otherwise specified, the Service Provider applies Hungarian VAT to all products.
    • When using electronic payment solutions, the payment is made in the currency specified by the Seller.
    • The Seller may withhold the delivery of the product until it verifies that the payment of the product's price has been successfully and completely made using the electronic payment solution (including cases where the Buyer transfers the purchase price in the currency of their Member State, and due to conversion and banking fees, the Seller does not receive the full purchase price).


     

    Appendix I Withdrawal/Cancellation Information Sheet

    • Right of Withdrawal/Cancellation
    • The Consumer is entitled to withdraw from this contract without justification within 14 days. Similarly, in the case of a service contract, if the performance of the contract has begun, the Consumer is entitled to cancel the contract without justification within 14 days. The withdrawal/cancellation period will expire 14 days after the day on which the Consumer or a third party other than the carrier and indicated by the Consumer acquires physical possession of the goods. To exercise the right of withdrawal/cancellation, the Consumer must notify the Service Provider of their decision to withdraw from/cancel this contract by an unequivocal statement (e.g., by mail or email) sent to the postal address: 2621 Verőce Migazzi u.3, or the email address: morejoyfullife@gmail.com provided in Section II of the T&C. The Consumer may use the model withdrawal/cancellation form available on our website (Appendix II) or make any other unequivocal statement expressing their intention to withdraw/cancel. If the Consumer submits the withdrawal/cancellation statement electronically as mentioned above, the Service Provider will promptly acknowledge receipt of the withdrawal statement to the Consumer. The Consumer will have exercised their right of withdrawal/cancellation within the 14-day period if they send their statement of withdrawal/cancellation before the period has expired.

    Effects of Withdrawal/Cancellation

    • If the Consumer withdraws from this contract, we shall reimburse all payments received from the Consumer, including the costs of delivery (except for the supplementary costs resulting from the Consumer's choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about the Consumer's decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or the Consumer has supplied evidence of having sent back the goods, whichever is the earliest. If the Consumer has received goods in connection with the contract, the Consumer shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which the Consumer communicates their withdrawal from this contract to us. The deadline is met if the Consumer sends back the goods before the period of 14 days has expired. The Consumer will have to bear the direct cost of returning the goods. The Consumer is only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

    Appendix III Sample Information on Legal Warranty and Product Warranty

    1. Legal Warranty

    When can you exercise your legal warranty rights? You can exercise your legal warranty rights against Renáta Lőrincz Ev. (Service Provider) in the event of defective performance according to the rules of the Civil Code.

    What rights do you have based on your legal warranty claim? You can choose from the following legal warranty claims:

    • You can request repair or replacement, unless the fulfillment of the chosen warranty claim is impossible or would result in disproportionate additional costs for the obligor compared to the fulfillment of another warranty claim, considering the value of the service in a faultless state, the severity of the breach of contract, and the interest caused to you by fulfilling the warranty claim. If you did not or could not request repair or replacement, you may request a proportionate reduction of the price or have the defect repaired at the expense of the business, or have it repaired by someone else. In the final instance, if the business did not undertake the repair or replacement, could not fulfill this obligation under the conditions laid down by law, or if your interest in repair or replacement ceased, you may withdraw from the contract.
    • The law stipulates that the repair or replacement must be carried out within an appropriate time frame, taking into account the properties of the item and the interests of the entitled party.
    • You can switch from your chosen legal warranty right to another; however, you bear the cost of switching, unless it was justified, or the business gave a reason for it.

    What is the deadline for enforcing your legal warranty claim? As a general rule, you can enforce your legal warranty claim within one year from the date of performance. However, in contracts between a consumer and a business, the warranty period is longer: you can enforce your legal warranty claim within two years from the date of performance. You must notify the defect immediately after discovering it, but no later than two months from the discovery of the defect. However, please note that you cannot enforce your legal warranty rights beyond the two-year limitation period from the date of performance. It is important to note that the period for repair is not included in the limitation period during which you cannot use the item as intended. The limitation period for the legal warranty claim restarts for the repaired or replaced part of the item. This rule also applies if a new defect arises as a result of the repair.

    Against whom can you enforce your legal warranty claim? You can enforce your legal warranty claim against the business (Service Provider).

    What are the other conditions for enforcing your legal warranty rights? Within six months of the date of performance, there are no additional conditions for enforcing your legal warranty claim beyond notifying the defect if you can prove that you purchased the product or received the service from Renáta Lőrincz Ev. (Service Provider). After six months from the date of performance, however, you must prove that the defect already existed at the time of performance. Furthermore, if you knew or should have known about the defect at the time of concluding the contract, you cannot enforce your warranty claim for that defect.

    2. Product Warranty

    When can you exercise your product warranty rights? In the case of a defect in a movable item (product), you can choose to enforce either the right specified in point 1 (legal warranty) or a product warranty claim.

    What rights do you have based on your product warranty claim? As a consumer, you can only request the repair or replacement of the defective product under the product warranty, unless repair or replacement is impossible or would result in disproportionate additional costs considering the value of the product in a faultless state and the severity of the defect.

    When is the product considered defective? The product is defective if it does not meet the quality requirements in force at the time of its release for sale by the manufacturer or if it does not have the properties specified by the manufacturer.

    What is the deadline for enforcing your product warranty claim? You can enforce your product warranty claim within two years from the date the product was released for sale by the manufacturer. After this period, you lose this right.

    Against whom and under what other conditions can you enforce your product warranty claim? You can only enforce your product warranty claim against the manufacturer or distributor of the movable item. In the case of a product warranty claim, you must prove that the defect existed at the time of the product's release for sale. According to the Civil Code, you must notify the defect to the manufacturer/distributor without delay after discovering it. A defect reported within two months of discovery must be considered notified without delay. You are responsible for any damage resulting from the delay in notification.

    Under what conditions is the manufacturer (distributor) exempt from product warranty obligations? The manufacturer (distributor) is only exempt from product warranty obligations if they can prove that:

    • They did not manufacture or distribute the product in the course of their business activities.
    • The defect was not detectable according to the state of science and technology at the time of the product's release for sale.
    • The defect in the product results from the application of legislation or mandatory regulatory requirements.

    The manufacturer (distributor) only needs to prove one of these reasons to be exempt.

    Please note that you cannot enforce both legal warranty and product warranty claims simultaneously and in parallel for the same defect. However, if your product warranty claim is successful, you can enforce your legal warranty claim for the repaired or replaced product against the manufacturer.

    WARRANTY

    In the case of a warranty, the Service Provider must fulfill its warranty obligations under the conditions specified in the warranty statement or legislation during the warranty period. The warranty does not affect your rights arising from the law (such as legal warranty rights), and the rights arising from the warranty are independent of the warranty rights. The Service Provider is exempt from warranty obligations if they prove that the cause of the defect occurred after performance. The Service Provider informs the Buyer that the Web Store only sells products that are not listed among the new durable consumer goods in Annex 1 of Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods sold in contracts with consumers. Therefore, the mandatory warranty obligations prescribed by law do not apply to the products sold by the Service Provider.
